The sentencing phase of the criminal process is subject to much scrutiny. Much like the arrest decision, decisions at sentencing have been criticized for being biased and impartial. How valid is this criticism? What is more important when sentencing an offender: legal or extra-legal variables? Provide empirical support for your position.

Additionally, many portray an image of defense attorneys, particularly public defenders, as too willing to plead their clients guilty. Does type of counsel make a difference in the court room?
